| LATEST UPDATE ON ARB REGULATIONS FOR OCEAN GOING VESSELS IN CALIFORNIA WATERS |

We had informed you that the Pacific Merchant Shipping Association had successfully appealed CARB regulations mandating the applicability to 24 nautical miles off the coast. At that time, the court had agreed that the CARB had no mandate to regulate air pollution beyond 3 nautical miles from the coast.
On Tuesday the 9th of April 2011, Circuit Court of Appeals rejected the industry contention and ruled that the air pollution rules of CARB would be applicable within 24 miles of the coast. This means that ocean-going vessels will use either marine gas oil (MGO), with a maximum 1.50% sulphur, or marine diesel oil (MDO), with maximum 0.50% sulphur, within 24 nautical miles off California's coast.
